1. Purpose<\/strong><\/span><\/p>\n

These general terms and conditions of sale (GTC) govern the contractual relationship between Digital Store Media (hereinafter referred to as \u00ab\u00a0the Seller\u00a0\u00bb) and its customers (hereinafter referred to as \u00ab\u00a0the Customer\u00a0\u00bb) for the sale of digital screens and the provision of associated services, namely installation, maintenance, and updating of products by the service provider WAYLIGHT.<\/span><\/p>\n

<\/span><\/p>\n

2. Acceptance of the Terms<\/strong><\/span><\/p>\n

<\/span><\/p>\n

Any order placed with Digital Store Media implies the unconditional acceptance of these general terms and conditions of sale by the Customer. No special condition may, unless formally and in writing accepted by Digital Store Media, prevail over these GTC.<\/span><\/p>\n

<\/span><\/p>\n

3. Orders<\/strong><\/span><\/p>\n

<\/span><\/p>\n

All orders must be confirmed in writing, either electronically or on paper. Digital Store Media reserves the right to refuse any order for legitimate reasons, particularly in the event of a dispute regarding the payment of a previous order.<\/span><\/p>\n

<\/span><\/p>\n

4. Prices<\/strong><\/span><\/p>\n

<\/span><\/p>\n

The prices of products and services are indicated in euros and excluding taxes. They may be modified at any time, without notice. Delivery, installation, maintenance, and update costs are billed in addition and are specified to the Customer when placing the order.<\/span><\/p>\n

<\/span><\/p>\n

5. Payment<\/strong><\/span><\/p>\n

<\/span><\/p>\n

Payment for orders is made by bank transfer, credit card, or any other payment method accepted by Digital Store Media. Payment must be made within the time limits indicated on the invoice. In the event of late payment, late payment penalties will be due, calculated based on a rate equal to three times the legal interest rate in force.<\/span><\/p>\n

<\/span><\/p>\n

6. Delivery<\/strong><\/span><\/p>\n

<\/span><\/p>\n

Digital Store Media undertakes to deliver the products within the time limits indicated when placing the order. In the event of a delay in delivery, the Customer will be informed as soon as possible. The risks related to the loss or damage of the products are transferred to the Customer upon receipt of the products6.<\/span><\/p>\n

<\/span><\/p>\n

7. Installation<\/strong><\/span><\/p>\n

<\/span><\/p>\n

The installation of digital screens is carried out by the service provider WAYLIGHT. The Customer undertakes to provide access to the premises and the necessary equipment for the performance of the installation services.<\/span><\/p>\n

<\/span><\/p>\n

8. Maintenance and Update<\/strong><\/span><\/p>\n

<\/span><\/p>\n

The service provider WAYLIGHT ensures the maintenance and updating of the products sold by Digital Store Media. These services are provided according to the terms defined in the maintenance contract concluded between the Customer and WAYLIGHT.<\/span><\/p>\n

<\/span><\/p>\n

9. Warranty<\/strong><\/span><\/p>\n

<\/span><\/p>\n

The products sold by Digital Store Media benefit from a conformity warranty and a warranty against hidden defects, in accordance with the legal provisions in force. Any claim must be made in writing, within fifteen days of receipt of the products.<\/span><\/p>\n

<\/span><\/p>\n

10. Liability<\/strong><\/span><\/p>\n

<\/span><\/p>\n

Digital Store Media cannot be held liable for indirect damages resulting from the purchase or use of the products and services, such as loss of turnover, data, or customers. The liability of Digital Store Media is limited to the amount of the order placed by the Customer.<\/span><\/p>\n

<\/span><\/p>\n

11. Intellectual Property<\/strong><\/span><\/p>\n

<\/span><\/p>\n

All elements of the Digital Store Media brand and its products, whether visual or sound, including the underlying technology, are protected by copyright, trademark, or patent law. They are the exclusive property of Digital Store Media.<\/span><\/p>\n

<\/span><\/p>\n

12. Personal Data<\/strong><\/span><\/p>\n

<\/span><\/p>\n

The personal data collected by Digital Store Media when placing orders are processed in accordance with the regulations in force. The Customer has the right to access, rectify, and delete data concerning them, which they can exercise by contacting the customer service of Digital Store Media.<\/span><\/p>\n

<\/span><\/p>\n

13. Disputes<\/strong><\/span><\/p>\n

<\/span><\/p>\n

These general terms and conditions of sale are subject to French law. Any dispute relating to their interpretation and\/or execution will be submitted to the competent courts of the jurisdiction of the registered office of Digital Store Media.<\/span><\/p>\n
